Financial Authority Regulation Implementation of Financial Services Alternative Dispute Resolution (LAPS SJK) in General Insurance Disputes under Indonesian
This study examines the implementation of Financial Services Alternative Dispute Resolution through the Financial Services Sector Dispute Resolution Institution (LAPS SJK) in resolving general insurance disputes under Indonesian Financial Authority Regulation (POJK) No. 61/POJK.07/2020. The purpose of this research is to analyze the legal framework, effectiveness, and challenges of LAPS SJK as a mandatory dispute resolution mechanism in the financial services sector, particularly in general insurance disputes. This research employs a normative juridical method with a statutory, conceptual, and case approach, supported by secondary legal materials and relevant dispute resolution practices. The results indicate that the implementation of LAPS SJK has strengthened consumer protection by providing a structured, accessible, and non-litigation-based dispute resolution mechanism. However, several legal and practical issues remain, including limited public awareness, procedural inconsistencies, and constraints in enforcing dispute resolution outcomes. The study concludes that although POJK No. 61/POJK.07/2020 provides a sufficient legal foundation for LAPS SJK, regulatory refinement and institutional strengthening are necessary to enhance legal certainty, fairness, and effectiveness in general insurance dispute resolution. This research contributes to the development of financial services dispute resolution law and offers policy recommendations to improve the future implementation of LAPS SJK in Indonesia.
